Acceptance of Terms

By downloading, installing, or using the Bingwa Flash mobile application or accessing any part of bingwaflash.co.ke (collectively, "the Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not download or use the Service. Continued use of Bingwa Flash constitutes acceptance of any updates to these Terms.

What Bingwa Flash Does

Bingwa Flash is an Android automation tool designed exclusively for Safaricom agents in Kenya. The App reads incoming M-Pesa payment SMS messages and automatically executes the corresponding USSD sequences on the agent's device, enabling faster fulfilment of data bundles, airtime, and other offers.

Additional features available within the Service include:

  • Multi-step and fallback USSD automation
  • SMS relay between sender and receiver agent devices
  • A personal web order page accessible at bingwaflash.co.ke/order/?u=username
  • STK push payment processing for web orders via M-Pesa
  • Client registration and management (clientele list)
  • Transaction scheduling and retry logic
  • Agent alerts, blacklisting, and transaction logs

Bingwa Flash does not initiate any payment or USSD action without a corresponding M-Pesa trigger SMS or explicit agent configuration. The App only acts on payments that have already been made.

Eligibility

To use Bingwa Flash as an agent you must:

  • Be at least 18 years of age
  • Hold a valid and active Safaricom agent account or till number
  • Operate in Kenya and comply with Safaricom's agent terms and conditions
  • Own or have authorised access to an Android 7.0 or higher device

End customers who use an agent's web order page to place orders do not need a Bingwa Flash account, but must provide a valid Safaricom M-Pesa number to complete a transaction.

Account & Security

Agent accounts are created using a valid email address and are authenticated through Firebase Authentication. You are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us immediately at support@bingwaflash.co.ke if you suspect unauthorised access
  • Not sharing your account with other individuals

Client users who register with an agent must create a 5-digit security PIN. This PIN protects your registration record and is required to add yourself to additional agents or remove yourself from an agent's list. You are solely responsible for keeping this PIN safe. We cannot recover a forgotten PIN — contact support to request a manual reset.

Bingwa Flash staff will never ask for your PIN or M-Pesa password. Do not share these with anyone claiming to represent us.

Agent Responsibilities

By using the automation features of Bingwa Flash, you as an agent accept full responsibility for:

  • Ensuring your device remains charged and connected for the App to function
  • Configuring USSD codes, offer prices, and offer categories accurately
  • Verifying that all configured offers are valid and currently available on Safaricom's network
  • Managing and reviewing the transaction log for any failed or flagged orders
  • Responding to customers whose orders fail or are retried
  • Ensuring any SMS relay partnerships with other agents are mutually agreed upon
  • Complying with Safaricom's terms of service for agents at all times

Important: Bingwa Flash automates actions based on SMS triggers. If a USSD code is incorrectly configured or a Safaricom service changes, automated orders may fail or send to wrong recipients. Agents are solely responsible for verifying their configurations and handling any resulting customer complaints or refunds.

Client Registrations

The Bingwa Flash client registration system allows end customers to register their M-Pesa number with an agent's client list. By registering as a client you acknowledge:

  • Your name and phone number will be stored in Bingwa Flash's database and shared with the specific agent you register under
  • Your agent may use this information to recommend data offers or bundles to your number
  • You may be registered under a maximum of 3 agents simultaneously
  • You can remove yourself from any agent's client list at any time via bingwaflash.co.ke/clients/ using your PIN
  • Removing yourself from an agent's client list takes effect immediately and syncs to their app

Agents may also remove clients from their list at their discretion, including if a number is blacklisted or the agent ceases operations.

Web Orders & Payments

Agents with web orders enabled receive a personal order page where customers can purchase offers by paying via M-Pesa STK push. By placing a web order you agree that:

  • Payment is processed directly through Safaricom M-Pesa — Bingwa Flash does not store or handle your M-Pesa credentials
  • The STK push prompt expires after 70 seconds — if you do not enter your PIN within this window, no charge is made
  • Once payment is confirmed by M-Pesa, the agent's app will process your order automatically
  • Fulfilment depends on the agent's device being online and the Safaricom USSD service being available at the time of payment
  • The offer price displayed on the order page is set by the agent and is the amount you will be charged

Bingwa Flash is a fulfilment automation tool. All payment transactions are governed by Safaricom M-Pesa's own terms. In case of a payment dispute, contact the agent directly or reach Safaricom on *234#.

Refund and reversal requests for failed orders must be raised directly with the agent. Bingwa Flash is not a party to the payment transaction between the customer and the agent.

Acceptable Use

You agree not to use Bingwa Flash to:

  • Violate any Kenyan law, Safaricom policy, or M-Pesa terms of service
  • Process payments for goods or services that are illegal, fraudulent, or prohibited
  • Attempt to reverse-engineer, decompile, or tamper with the App's source code
  • Use the SMS relay feature to intercept or forward messages without the explicit consent of all parties involved
  • Harass, spam, or send unsolicited messages to customers or other agents
  • Circumvent or abuse the client PIN system, including attempting to impersonate another user
  • Use automated scripts or bots to interact with the web order page in a way that constitutes abuse or denial of service
  • Resell or sublicense access to the App or its backend services

We reserve the right to suspend or permanently terminate any account found in violation of these rules, without prior notice and without liability.

Intellectual Property

All content within Bingwa Flash — including the App code, UI design, logos, website text, and backend systems — is the exclusive property of Bingwa Flash and is protected under applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to install and use the App solely for its intended purpose on your own device. This licence does not include:

  • The right to copy, modify, or distribute the App or any part of it
  • The right to use the Bingwa Flash name or logo in any commercial context without written permission
  • Any ownership claim over the App or its backend infrastructure

Disclaimers

Bingwa Flash is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The App will operate without interruption or error at all times
  • USSD automation will succeed on every transaction — Safaricom network conditions, USSD timeouts, and device limitations may cause failures
  • The App will remain compatible with all future Android versions or Safaricom service changes
  • Data stored in Firebase will never be lost, though we take industry-standard precautions

Bingwa Flash is a productivity tool for agents. It does not guarantee income, transaction volumes, or customer satisfaction. Agents use the App entirely at their own discretion and risk.

Limitation of Liability

To the fullest extent permitted by applicable law, Bingwa Flash and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Lost revenue or profits resulting from failed or misdirected USSD transactions
  • Customer complaints or disputes arising from delayed or incorrect order fulfilment
  • Any loss of data stored on your device or in your account
  • Unauthorised access to your account resulting from failure to secure your credentials
  • Service interruptions caused by Safaricom network downtime, M-Pesa outages, or Android system changes

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you have paid for the Service in the 12 months preceding the claim. As Bingwa Flash is currently free to use, this amount is zero.

Termination

You may stop using Bingwa Flash at any time by uninstalling the App and requesting deletion of your account data by emailing support@bingwaflash.co.ke.

We reserve the right to suspend or terminate your access to the Service immediately and without notice if:

  • You violate any provision of these Terms
  • We receive a verified complaint of fraud, abuse, or illegal activity associated with your account
  • Your account poses a risk to the security or integrity of the platform
  • We are required to do so by law or by a competent authority

Upon termination, your right to use the Service ceases immediately. Client registrations associated with your agent account may also be deleted.

Changes to These Terms

We may update these Terms from time to time to reflect changes in the App's features, legal requirements, or our operating practices. When we do, we will update the "Last updated" date at the top of this page.

If changes are material, we will make reasonable efforts to notify registered agents via the email address on their account. Continued use of the App after updated Terms are posted constitutes your acceptance of those changes.

We recommend bookmarking this page and checking it periodically, especially after receiving an App update notification.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
